BY-LAWS

  • No By-law shall conflict with the Articles of Association.

  • Colours and Burgees

  • The club colours shall be green and gold.

  • Club flags, burgees, logo and badges shall be as defined by the Committee.

  • Dress Regulations

    Club dress regulations shall be as defined by the Committee:

  • Neat tropical casual clothes including shirts with sleeves and footwear.

  • Work clothes, other than singlets, shall be permissible before 7.00pm.

  • No bare feet in the clubhouse with no exception. Wet clothing to be confined to the balcony.

  • No hats to be worn in the clubhouse except special events eg. Fancy dress.

  • Patron and Vice Patron(s)

    At the annual general meeting in each year a person(s) may be elected to the position of Patron or Vice Patron(s) of the club.


    If the person so elected shall not be a member of the club at the time of his election to such office, he shall be entitled, during his term of office, to full privileges of membership of the club without payment of subscription.


    Person(s) who are already members of the club who are so elected shall be entitled, during the term of his office, to full privileges of membership of the club without payment of subscription.

  • Classes of Members

  • Ordinary Members

    Shall be those persons who are or have been actively involved (engaged) in the sailing of yachts in the club sailing program, or in the administration and duties thereof of the club sailing program, on a regular basis.


    To be classified as being or having been actively involved in the sailing of yachts in the club sailing program, on a regular basis, members must satisfy one or more of the following criteria:


  • The member has sailed off-the-beach in at least one third of the club fixtures for the year or is a parent whose child has sailed in one third of the club fixtures for the year.

  • The member has sailed offshore yachts in at least one third of the club aggregate pointscore fixtures for the year.

  • The member has sailed offshore yachts in at least two thirds of the club non-aggregate pointscore races for the year.


    A combination of the above criteria may be accepted as satisfying the requirements for ordinary membership, with the proviso that the basic requirements shall be increased, rather than reduced.


    To be classified as being or having been actively involved in the administration of the club sailing program, on a regular basis, members must satisfy one or more of the following criteria:

  • The member is on the off-beach roster and has satisfied the attendance requirements for the year.

  • The member has assisted as a race official and/or has been in attendance and available to assist as a race official in at least one third of the Aggregate Pointscore race fixtures for the year.

  • The member has assisted the offshore fleet as a race official and/or has been in attendance and available to assist as a race official in at least two thirds of the club non-aggregate pointscore fixtures for the year.


    At the discretion of the sailing committee club sanctioned participation in events outside the club may be accepted as satisfying part of the requirements for ordinary membership.


    To retain ordinary membership, ordinary members must have been ordinary members before 1983/84, an ordinary member for a period of six (6) years or a flag officer of the club.

  • Life Members

    Preference for life membership shall be given to those persons who have been ordinary members of the club for at least 10 years and who have rendered distinguished service to the club over and above their peers.


    To be eligible for life membership a member must be nominated by one ordinary member and seconded by another ordinary member. The nomination shall be referred to a sub-committee who shall investigate and refer their recommendations to the Executive for its approval to submit to a General Meeting of Members.

  • Social Members

    Who shall be persons over the age of 18 years and who are interested in the social activities of the club. A social member is precluded from being eligible for nomination for or appointed to the Executive Committee of the club and shall not be eligible to vote. Social members privileges are restricted to the use of food, beverage and gaming facilities provided by the club and they are subject to all the obligations of the club.

  • Junior Members

    Shall be those persons over the age of ten (10) years and under the age of eighteen years who are actively engaged in sailing. Junior members must be capable of attending their craft and other associated duties independently. Permission must be obtained from their guardian(s) to become junior members.

  • Associate Members

    Who shall be persons over the age of 18 years who may wish to use the club facilities. Associate members shall be entitled to all the privileges and be subject to all the obligations of the club provided however that Associate Members shall not hold office and shall not be eligible to vote.

  • Absentee Membership

    Members who reside outside the Whitsunday area will be defined as outside the Shire of Whitsunday. Absentee membership will be set at half the annual membership fee. Absentee membership will be monitored.

  • Visiting Members and Guest Members

    Will not have the right to introduce guests to the club.


    The membership of a visiting member or guest member be terminated at any time by the Committee, a Committee member, dutyman, Clubhouse Manager or Secretary.

  • Guests of Members

    Any member may introduce a guest(s) to the club for the day of visit, provided such guests(s) remains in the company of the introducing member. Provided that any one guest shall not be introduced on more than six (6) days in any one (1) year. The name of the guest(s) shall be entered in the visitors book, and the book shall be signed by the introducing member.

  • Guests and Visitors

    No guest or visitor shall be introduced:

  • Who has applied for membership and failed in a ballot therefore until six months after such a ballot.

  • Who has been expelled pursuant to 7, ii, iii of the Articles of Association.

  • Who has been refused admission by the Committee. The Committee, a member of the Committee, Clubhouse Manager or Secretary may either specifically or generally refuse admission of any person at any time and from time to time.


  • Nomination of Members

  • Voting members may propose or second a person whom he has known personally, (and who is otherwise eligible for membership) for a period of at least one (1) month for admission as a member of the club.


  • The Committee shall have the power to limit from time to time the number of all classes of members.


  • The names and addresses of persons proposed as members of the club shall be displayed in a conspicuous place on the club premises for at least two weeks before their election.


  • Application of Membership

  • Subscriptions to be paid upon application for membership.


  • Names of nominees to be placed on Notice Board for a period of not less than two weeks.


  • Any past member who has allowed his/her membership to lapse shall be eligible at the discretion of the Executive Committee for re-admission as a member without payment of a nomination fee.


  • Termination of Membership

  • Members shall pay all accounts owing to the club by the due dates. The Executive Committee shall consider the termination of membership of any member who defaults on any account owing to the club.


  • Any member who defaults on any account owing to the club shall be required by the Executive Committee to show cause why his/her membership should not be terminated.


  • Commission of indictable offences and wilful breakage or destruction of property

  • Any member found within the Whitsunday Sailing Club premises or curtilage committing any offence deemed by law to be an indictable offence, including offences against the Drugs Misuse Act, may be called upon by the Executive Committee to show cause why that member should not be expelled pursuant to 7 (2) (ii) and (iii) of the Articles of Association.


  • No member of the club shall take away from the clubhouse, buildings or grounds, or deface, tear or injure any article, the property of the club, or for which the club may be responsible. Members removing, breaking or injuring any article the property of the club, or for which the club may be responsible, shall pay for the same.

  • Complaints

    All complaints shall be stated in a letter addressed to the Secretary and signed by the member complaining, which letter shall be laid before the Committee at the next meeting, and to such complaints an answer shall be sent by letter from the Secretary. No member shall make a complaint in any other manner or personally reprimand any employee of the club.

  • Provost Officer

    A Provost Officer may be appointed from time to time by the Executive Committee to supervise all employees of the club. The Provost Officer shall have sole responsibility for liaising between the Executive Committee and the staff. Any complaints concerning staff shall be referred in the first instance to the Provost Officer.

  • Financial Assistance

  • Financial assistance for representing the Club in regattas elsewhere is restricted to juniors who regularly participate in Club sailing events and who undertake their own fund raising activity for the purpose. The level of financial assistance is at the discretion of the Executive Committee, but may include a contribution towards the entry fees and a subsidy towards travel expenses, depending upon the extent of the fund raising effort expended by the applicant.


  • Members may with the approval of the Executive Committee undertake fund raising activity for purposes consistent with the Objects of the Club.

  • Sailing Activity

  • Yacht Register Sail Numbers

    A boat ceases to be on the club register once it has been sold to a non-member. A registered boat sold to a club member shall be re-registered.


    Sail numbers with the exception of class numbers and international numbers, which do not conform to the National Numbering System, are to be phased out. Offshore yachts with other than a National Number which are on the club register will be allocated a National Number, but shall not be required to change numbers until new sails are acquired.

  • Safety Certificates

    All owners of offshore yachts intending to race with the club shall complete an ISAF Safety Compliance Certificate, which shall apply each calendar year, and shall be renewable on 1 January each year. Visiting yacht owners, wishing to participate in club events shall either provide evidence of relevant and current safety compliance of their vessel with an AYF affiliated club elsewhere, or shall complete a WSC Safety Compliance Certificate before entry of their vessel in a club event will be accepted.

  • Operation of Safety Vessels

    Club safety vessels shall only be operated by members authorised by the Commodore to do so.

  • Offbeach Boats

    Offbeach boats are not permitted to compete in offshore races with the exception of Twilight race whereby a separate start is to be offered ahead of the offshore boats and sailed under the race rules.


  • Liquor License

  • The club shall open for the patronage of members between such hours as the committee may from time to time determine, subject to the provisions of the Liquor Acts.

  • The sale or supply of liquor to any person under the age of eighteen years shall be prohibited.


  • Use of Club Facilities

  • Boardroom

    Boardroom to be closed to other than WSC members.

  • Training Room

    The Training Rooms only to be hired out at the discretion of the Executive Committee.

  • Proserpine Lease

    No camping on Proserpine Lease without written permission.

  • Club Tractor

    That the club tractor be restricted in use to the club boats only. The club tractor shall only be operated by a member authorised by the Commodore to do so.

  • Boat/Trailer Storage on Club Foreshore Lease

    Such facility is only available to financial members of the club holding the appropriate class of membership. Further, please refer to Appendix A

  • Use of Careening Piles & Short Term Storage in Dinghy Basin

    The use of the careening piles for the purpose of repairs or maintenance of any kind is prohibited. Please refer to appendix B

  • Vessel parking in dinghy basin

    Parking of any vessel for the purpose of maintenance or repairs is prohibited.

  • Use of Club’s Launching Ramp

    Please refer to Appendix C

  • Boat Maintenance on Club Foreshore Lease

    Maintenance or repair of any vessel on the club foreshore is prohibited except with the specific written permission of the Committee.

  • Notice Board

    Notices may be posted on the classified noticeboard for a charge of $1.00 per month.


    (K) Car Parking and vehicular entry to Club Foreshore

    Only vehicles carrying current parking approval stickers are to be parked on the club foreshore. All other vehicles are to be parked in the upper car park.



    (L) Short term dinghy parking

    Dinghies may only be tied to the pontoons for the purpose of loading, unloading, and launching or retrieval. Dinghies drawn upon the beaches must have a current parking approval label attached as issued by the secretary.

    Relating to the House

  • Commercial Practices

    No commercial practices (other than club or related and approved practices) permissible on club premises.

  • Advertising

    No advertising other than by sponsors of the club to be permitted on club premises.

  • Dogs

    No dogs permitted on club lease except to egress or access vessels, but only when on a leash.

  • Photographer

    No photographer to be given exclusive rights at club functions, unless such photographer is appointed as the clubs official photographer.

  • Raffle Policy

    Tickets may only be sold at the club on approval of the Executive Committee.

  • Credit

    No credit to be granted. Members may cash personal cheques only.



    Appendix A

    Boat Trailer Storage on Club Foreshore Lease



    Conditions

  • Boat/Trailer storage is available exclusively to financial club members who have paid the appropriate fees (including bond) which shall be determined by the Executive Committee from time to time.

  • Application for storage shall be approved only by the Secretary, on behalf of the Executive Committee.

  • The maximum length of any vessel to be stored on the Club lease is 12 metres.

  • Identification stickers, issued by the club, must be attached to the vessel, trailer and nominated tow vehicle.

  • The allocated site shall be kept clean and tidy at all times.

  • Vessels to be stored on club premises must be insured (proof will be required upon application).

  • An indemnity must be signed.

  • Boat/Trailer spaces may be required to be vacated for special events as determined by the Executive Committee.


    Prohibitions in Relation to Boat/Trailer Storage

    Repairs and Maintenance is prohibited under this Agreement without specific written permission of the committee not withstanding the following exclusion of:-

    • Open air grinding of fibreglass will not be permitted.

    • Any grinding or sanding is likely to cause a nuisance will not be permitted

    • Spray painting will not be permitted.

    • Noise pollution likely to be a nuisance is prohibited.

    Other prohibitions include:-

    • The storage of hazardous, inflammable or explosive materials on Club premises is strictly prohibited.

    • Living on board vessels within the Club lease is prohibited except in extenuating circumstances approved in writing by the Secretary.

    • Commercial operations from the launching ramp.

    • Car parking is not permitted on the foreshore lease – cars shall be parked in the upper car park only.

    Appendix B

    Use of Careening Piles &
    Short Term Storage in Dinghy Basin Conditions


    Careening

  • The use of the Careening Piles and the dinghy basin for repairs or maintenance of any kind is prohibited.

  • Emergency careening of a vessel in danger of sinking may be approver by the committee or the secretary. Such approval must be in writing stating full details and nature of the emergency

  • Owners/skippers of vessels to be careened shall have sole responsibility for navigating to and from the careening area including and especially the determination of the depth of water at the careening position in relation to their vessel. The club advises that depth of water at the careening piles may be approximately 1.5 metres less than the state of the tide according to the tide charts, but emphasises that the responsibility for determining the actual depth of water at the careening position rests with the person careening the vessel.

  • The careening site shall be left in a clean and tidy condition before the bond will be returned.

  • Emergency Careening may only be permissible for a maximum of three days.

  • Vessels to be stored on club premises must be insured (proof will be required upon application). The insurance shall indemnify the club against any action or incident, which may occur as a result of this Agreement.

  • All waste is to be removed from club premises prior to departure.

  • An indemnity must be signed.


    Prohibitions in Relation to the Above Areas

    • Noise of a level likely to be a nuisance to others is not permitted.

    • Car parking is not permitted on the foreshore lease – cars shall be parked in the upper car park only.

    • The storage of hazardous, inflammable or explosive materials on club premises is strictly prohibited.

    • Grinding or machine sanding of fibreglass, spraying of paint or carrying out of any other maintenance activity is strictly prohibited.

    • Living on board vessels within the Club lease is prohibited except in extenuating circumstances and approved by the Secretary.

    Appendix C

    Use of Club’s Launching Ramp


  • Use of the club’s launching facilities is available exclusively to financial club members who hold appropriate membership and have paid the appropriate fees which shall be determined by the Executive Committee from time to time for the use of these facilities.

  • Application for launching rights shall be approved only by the Secretary, on behalf of the Executive Committee.

  • Identification stickers, issued by the club, must be attached to the vessel, trailer and nominated tow vehicle.

  • An indemnity must be signed.


    General Rules in Relation to the Use of the Launching Ramp

  • Do not enter the ramp whilst it is in use.

  • Clear the ramp quickly.

  • Priority shall be given to launching and retrieving of club rescue craft.

  • Rigging and other preparation must be undertaken away from the ramp and its access.

  • When flushing motors be mindful of noise pollution – idling revolutions only.

  • Trailers must be returned to their allocated spaces if applicable. If no space has been allocated the trailer must be parked in the upper car park.

  • Vehicles shall not be left unattended on club grounds or block access to the ramp, trailable yachts hard stand or any other area.


    Prohibitions in Relation to the Use of the Launching Ramp

    • Commercial operations are prohibited.

    • Car parking is not permitted on the foreshore lease – cars shall be parked in the upper car park only.

    Appendix D

    Boat Maintenance on Club Foreshore Lease


    Conditions

  • Boat maintenance or repairs is prohibited except with the specific written approval of the committee.

  • Application for storage for repairs and maintenance shall be approved only by the Executive Committee.

  • The maximum length of any vessel to be stored on the Club lease is 12 metres.

  • The maximum period allowable for maintenance is 28 days. Penalties shall apply for breaches of this condition.

  • Vessels to be stored on club premises must be insured (proof will be required upon application). The insurance shall indemnify the club against any action or incident which may occur as a result of this Agreement.

  • The maintenance area shall be kept neat and tidy during the maintenance period.

  • Chemicals and inflammable materials shall be removed overnight; and relevant OH&S Hazchem signage shall be displayed while any such materials are in use on the premises.

  • All waste is to be removed from club premises at the completion of the maintenance work, and the site shall be cleaned and tidied before bond will be returned.

  • Persons to be engaged in the maintenance shall either be members, or in the company of a member. Persons so engaged shall carry their own insurances.

  • An indemnity must be signed.


    Prohibitions in Relation to Boat Maintenance

    • Grinding or machine sanding of fibreglass, spraying of paint or carrying out of any other activity which might be injurious to health on club premises is strictly prohibited.

    • The overnight storage of hazardous, inflammable or explosive materials on Club premises is also strictly prohibited.

    • Noise pollution is strictly prohibited.

    • Living on board vessels within the Club lease is prohibited except in extenuating circumstances and approved by the Secretary.

    • Car parking is prohibited on the foreshore lease – cars shall be parked in the upper car park only.
